1. area of validity

These general trading conditions apply to all business relations between the ExoFood e.U. and its customers in the respective, at the time of the conclusion of the contract valid version.

2. Contract conclusion

The presentation of the assortment in our online store does not constitute an offer within the meaning of § 861 ABGB. It is subject to change and non-binding. Through the online store, the customer is invited to submit an offer to conclude a purchase contract. With sending the order by the customer, the contract is not yet concluded. The customer receives a confirmation of receipt of the order by e-mail (order confirmation). This order confirmation does not represent an acceptance of the offer, but is only intended to inform the customer that the order has been received by ExoFood e.U. The contract with ExoFood e.U. comes about when ExoFood e.U. accepts the customer's offer by ExoFood e.U. sending the ordered product to the customer and confirming the dispatch to the customer with a second e-mail (dispatch confirmation). The contract is stored by ExoFood e.U. for the purpose of processing the purchase contract.

3. Withdrawal policy
Right of withdrawal
Customers who are consumers as defined by the Consumer Protection Act may withdraw from the contract within a period of 14 working days from receipt of delivery of the ordered goods. It is sufficient if the declaration of withdrawal is sent within the period without giving reasons. Saturdays do not count as working days.

In the case of withdrawal, a full or partial refund of the purchase price will take place only concurrently with the return of the goods received from the customer. The costs of the return are to be borne by the customer.The goods should be returned in unused and as new resalable condition and in the original packaging. For items that are impaired by signs of use, we will charge an appropriate fee for the reduction in value. The same applies if accessories or parts are missing when the goods are returned.The costs of return shipment shall be borne by the customer. If the goods are returned freight collect, we are entitled to retain or invoice a corresponding amount.

4. Warranty and Liability
Perishables must be stored refrigerated or frozen. Since the goods are perishable (for which no legal warranty is provided), we can only replace or repair the goods if we are notified immediately (immediately after receipt of the delivery). If the packaging of the goods is obviously damaged, the integrity of the goods is to be checked immediately, in order to return them immediately to the delivery service in case of possible damage (refuse acceptance).Apart from the above exception, we reserve the right to fulfill the warranty claim for the other items in our web store at our discretion by improvement, exchange or price reduction. The customer must always prove that the defect was already present at the time of delivery. Hidden defects must be reported immediately after their discovery. If a notice of defect is not made or not made in time, the goods shall be deemed to have been approved. The assertion of warranty claims or claims for damages as well as the right to contest errors due to defects, are excluded in these cases. The legal warranty period in Austria is two years for movable goods and three years for immovable goods. The warranty period begins with the complete delivery of the service.

5. Prices and shipping costs
The prices at the time of the order are valid.The period of validity of our limited offers you will find out where they are displayed in the store.All prices include the legal value added tax. With an order placed in our online store ExoFood e.U. delivers within Austria from an order value of EUR 60.00 without shipping charges.Below an order value of EUR 60.00 we charge a flat rate for postage of EUR 5.60 per delivery, regardless of the size and weight of the shipment.The shipping costs for other countries please refer to the item "Shipping costs" on our homepage.

6. Shipping
ExoFood e.U. will deliver the ordered goods to the address specified by the customer in the order.Within the EU we deliver duty free. For delivery to countries outside the EU, especially Switzerland, the customer is responsible for any duties, taxes and other fees.If an ordered item is not in stock, we reserve the right to send you the remaining items.As soon as the non-stock item is available again, it will also be sent to you subsequently.This will result in additional shipping costs.If you do not want this, we ask you to indicate this when ordering. Thus, we will wait with the delivery of the goods until all items can be shipped at once.In case of delivery delays, we will inform you immediately.

Until payment is made in full, the goods remain the property of ExoFood e.U.

8. Payment, due date, delay
The payment of the goods can be made by Paypal (credit cards) or prepayment. ExoFood e.U. reserves the right to accept only certain payment methods in individual cases. Payment by sending cash or checks is unfortunately not possible. We exclude liability in case of loss.Payment in advanceWhen paying in advance, the customer receives an e-mail including invoice and bank details. The transfer must be made within 10 working days. Otherwise, the customer's order will be canceled.When redeeming vouchers, please note the specific applicable redemption conditions such as minimum order quantity, validity, etc.. In any case, only one voucher or order / customer-related discount can be redeemed per purchase. Cash payment and subsequent offsetting against previous orders is not possible. A resale is also not permitted.
